New Draft Regulations on Organic Production (October 2001)
Section 2: Scope of regulations
(1) (a)
These regulations apply to the following products which carry, or are
intended to carry, descriptive labelling referring to organic production
methods:
(i) unprocessed plants and plant products;
(ii) live animals;
(iii) products from bee keeping; and
(iv) processed products for human consumption derived mainly from those
listed in subparagraph (i), (ii) and (iii).
(b)
A product will be regarded as bearing indications referring to organic
production methods where, in the labelling of claims, including advertising
material or commercial documents, the product, or its ingredients, is
described by the terms "organic", "biological", "ecological",
or words of similar intent including diminutives which, in the country where the
product is placed on the market, suggests to the purchaser that the product or
its ingredients were obtained according to organic production methods.
(c)
Subregulation (2)(b) does not apply where these terms clearly have no
connection with the method of production described in these regulations, such as
organic compounds referred to in organic chemistry.
(2) These regulations are in addition to and not in substitution of any other
relevant legislation applicable to the products concerned.
